CBD and Hemp Products: The Newest Addition

Monday, September 23, 2019/Categories: Made in Montana

*The following does not constitute legal advice and is meant only to provide education on existing statutes and policies. If you have specific questions regarding the legality of hemp products in Montana, please seek private counsel.

We are excited begin accepting applications for CBD and hemp products. At this time, producers or manufacturers of hemp products, seeds and CBD oil with THC less than 0.3% are eligible to apply to the Made in Montana program.

With these exciting additions to the list of products we certify as Made in Montana, please note some new information to ensure our program follows existing Montana statutes.

As always, if you have any questions about the Made in Montana program, please call us at 841.2757 or email madeinmontana@mt.gov.

1. Official Policy

The Department of Commerce spent time reviewing current and evolving Federal and State policies as they apply to the Made in Montana, Grown in Montana, Native American Made in Montana, and Taste our Place applications for hemp, CBD products and medical marijuana.

Applications for hemp products, seeds, and CBD oil with THC less than 0.3% will be considered for the Made in Montana program.  All applicants must complete a self-attestation that your products contain less than 0.3% THC and follow existing guidelines for Made in Montana applications.

If you are already a member producing these products, you will receive a letter and self-attestation form in the mail. Please fill this self-attestation and return it to our office at:

Through the Montana State Hemp Program, producers can apply for a license. Applicants must agree to comply with Section 80-18-101 through 80-18-111 of MCA and ARM 4.19.101-106, adopted on March 10, 2017. An industrial hemp license is required prior to planting hemp seeds in Montana.
